| Abstract: | Статтю присвячено проблематиці застосування та використання зброї та спеціальних засобів для примусової зупинки транспортного засобу, якщо водій своїми діями створює загрозу життю чи здоров’ю людей та/або поліцейського. У статті наголошено, що цей вид поліцейського примусу є досить травматичним для водія, пасажирів та сторонніх осіб на місці події, а поліцейському загрожує настанням кримінальної відповідальності за навмисне вбивство або перевищення службових повноважень. Здійснено аналіз нормативно-правових повноважень із застосування поліцейськими вогнепальної зброї, який дав змогу висвітлити їх недосконалість та запропонувати зміни до Закону України «Про Національну поліцію». Зазначено, що термінологічний апарат у цьому законі логічно неузгоджений, що утворює правові колізії. Акцентовано на потребі ефективної вогневої підготовки з використанням інноваційних технологій, зокрема інтерактивних тирів та автомобілівтренажерів, які імітують стрільбу в русі, та симуляцій обстановки, в якій може виникнути потреба зупинки транспортного засобу із застосуванням зброї. |
| Description: | The article is devoted with the issue of the use and application of weapons and special means for forcible stopping of a vehicle, if the driver’s actions endanger the life or health of people and / or police officers. The article emphasizes that this type of police coercion is quite traumatic for the driver, passengers and bystanders at the scene, and the police officer faces criminal liability for premeditated murder or abuse of office. Statistics of foreign empirical research on this issue are presented to confirm the danger of using weapons to stop a vehicle. An analysis of the legal powers for the use of firearms by police officers was made, which provided an opportunity to highlight their imperfections and propose amendments to the Law of Ukraine «On the National Police». In particular, it is noted that the terminological apparatus in this law is logically inconsistent, which creates legal conflicts. Given the possible negative consequences of the use of firearms by police, it is necessary to clearly define and agree on the concepts and terms associated with it, to disclose in detail their content. The cornerstone of this issue is the definition of the terminology «weapons», «firearms», as well as «use», «application» and «active use of weapons». Cases of stopping a vehicle with the help of firearms should be defined by the term «use» with appropriate changes in the relevant law, which will emphasize the prohibition of injuring the driver or passengers of his car. The development of the law enforcement system as a whole requires improving the police training system, using new methods and ways of training, paying special attention to developing skills in the use of firearms through interactive simulation (simulation) of real conditions in the form of tactical situational tasks using special simulators. Emphasis is placed on the need for effective fire training using innovative technologies, in particular, interactive shooting ranges and simulators that simulate shooting in motion, and simulations of the situation in which it may be necessary to stop a vehicle with a weapon. |
