| Abstract: | У статті наведено науковий аналіз способів та методів легалізації доходів, коштів та інших активів, що були отримані незаконним шляхом. Метою цього дослідження є визначення основних стадій легалізації доходів отриманих незаконним шляхом. Основна увага сфокусована на етапах (стадіях) відмивання наявних коштів. З юридичного погляду легалізація полягає у наданні правомірного виду володінню, користуванню та розпорядженню грошовими коштами або іншими активами шляхом здійснення фінансових операцій чи інших угод. З позиції реальної економіки легалізація пов’язана з надходженням неврахованих раніше коштів у легальну економіку. Результати, сформульовані у цій статті, можуть бути використані в теорії та практиці оперативно- розшукової діяльності органів внутрішніх справ щодо протидії легалізації доходів, отриманих від скоєння протиправних дій. |
| Description: | The article provides a scientific analysis of methods and methods of legalization of income, funds and other assets that were obtained illegally. The purpose of the research is to determine the main stages of legalization of illegally obtained income. The main attention is focused on the stages of existing funds laundering. From a legal point of view, legalization consists in providing a legal form to the possession, use and disposal of money or other assets through financial or other transactions. From the point of view of the real economy, legalization is connected with the inflow of previously unaccounted funds into the legal economy. It has been noted that the legalization of income has three main stages, including placement, stratification and integration. At the first stage, legalization methods can be grouped into the following categories: traditional financial institutions; non-traditional financial institutions; institutions of the nonfinancial sector and outside the state. The second stage is called stratification. It refers to the separation of illegal income from its sources by creating a complex chain of financial transactions, with the aim of masking the traces of illegally obtained income. The third stage of money laundering is integration, which is directly aimed at providing the appearance of legality of criminally obtained financial funds. The task of this phase is to find a legal source of origin for the money and invest it in the legal economy. Different methods are used at different stages, among them the following can be noted: merger of legal and illegal funds; purchase of property for cash; transfer of criminally obtained money outside the state; removal of money hidden in vehicles or cargo; postal shipments; hidden withdrawal of money by couriers; underground banking systems, etc. The results formulated in this article can be used in the theory and practice of operational investigative activities of the internal affairs bodies regarding countering the legalization of income obtained from committing illegal acts. |
