| Короткий огляд (реферат): | У статті розглядаються проблеми побудови системи адміністративно-правового забезпечення процесу комерціалізації об’єктів інтелектуальної власності. Сформульовані конкретні пропозиції щодо стратегічних напрямів подальшого удосконалення адміністративноправових засад процесу комерціалізації об’єктів інтелектуальної власності, які повинні бути зосереджені на вирішенні наступних трьох комплексів базових проблем: проблем нормативної, інституційної та інфраструктурної бази. Наголошено на необхідності систематизації вітчизняного законодавства про комерціалізацію об’єктів інтелектуальної власності. Аргументовано наявність потреби удосконалення інституційної бази процесу комерціалізації об’єктів інтелектуальної власності. Обґрунтовано пріоритетність завдання удосконалення інфраструктурної бази процесу комерціалізації об’єктів інтелектуальної власності. |
| Опис: | The article deals with the problems of building a system of administrative and legal provision of the process of commercialization of intellectual property objects. Formulated specific proposals for the strategic directions for further improvement of the administrative-legal principles of the process of commercialization of intellectual property objects, which should be focused on solving the following three complexes of basic problems: problems of the normative, institutional and infrastructure base. It is emphasized the need to systematize the domestic legislation on administrative liability for offenses in the field of intellectual property, adaptation of domestic legal acts in the field of intellectual property to the relevant acts of the European Union, normative regulation of the problem of utilization of intellectual property objects, creating a normative base for the protection of intellectual property in the military Technical sphere, as well as improving the legislative framework of the system of collective management of property author and adjacent rights. Presence of the need to improve the institutional basis for the process of commercialization of intellectual property objects in the direction of implementing the concept of creation in Ukraine of a single intellectual property body, the assembly of the system of commercialization of intellectual property objects and high-level specialists, establishing interaction between state and private institutions, deepening cooperation with International organizations in this area, establishing cooperation with the relevant state bodies of other countries, supporting the activities of public organizations in the field of intellectual property. The priority of the task of improving the infrastructure base of the process of intellectual property objects is substantiated by intensifying activities to disseminate knowledge about intellectual property, education of respect for intellectual property, improving the interaction of inventors, scholars and businesses, as well as the development of innovation activity and technology transfer, improving the mechanism of acquiring legal Protection and creation of appropriate conditions for the commercialization of intellectual property objects. |
