| Abstract: | Здійснено огляд порядку надання Національною поліцією України адміністративних послуг з видачі дозволів на придбання і перевезення вогнепальної зброї. Зазначено особливості такої процедури стосовно юридичних та фізичних осіб. З метою належного контролю та посилення гарантій безпеки та правопорядку в державі запропоновано зміни до чинного законодавства у відповідній галузі. |
| Description: | The author has described the procedure of delivering by the National Police of Ukraine of administrative services of authorization for purchase and transportation of firearms. He has marked peculiarities of such procedure with regard to legal entities and individuals. The author has concluded that the realization of the right to purchase, storage, transportation or carry firearms and ammunition to it may be exercised by a limited number of actors: ministries, other central executive authorities, enterprises, institutions, economic entities and individuals who, regarding the performance of their official duties, require additional security. Other legal entities, such as Ukrainian citizens as individuals, deprived of the right to possess and use firearms to protect their lives, health, property and other purposes. In order for such entities to exercise their rights to firearms, they must apply to the police for permission. According to the current legislation, the Department of reventive Activities of the National Police of Ukraine and its territorial units may provide administrative services for the issuance of permits to such actors for: 1) the purchase of firearms and ammunition; 2) transportation of firearms and ammunition on the territory of Ukraine or through the customs border of the country; 3) storage of firearms and ammunition; 4) carrying departmental weapons; 5) storage and carrying of firearms. Issuance of such permits shall be carried out according to the current legislation of Ukraine. To properly control and strengthen the guarantees of security and law and order in the country, he has offered amendments to the current legislation in the relevant field. Іn his opinion, these administrative services need special government control considering that firearms are such an object of the permission system, which has an increased level of danger to citizens’ life and health in particular and to law and order in general. |
