Abstract: На підставі вивчення доктринальних джерел, судової практики, в тому числі рішень Європейського суду з прав людини, визначено об’єкт злочинів, пов’язаних із невиконанням рішень суду у кримінальному провадженні (ст.ст. 382, 389, 3891, 390 КК України). Доведено, що ним є встановлений порядок належного виконання вироків, ухвал та постанов суду і призначеного ним покарання.
In the article, based on the study of doctrinal sources, jurisprudence, including decisions of the European Court of Human Rights, identified the object of crimes related to nonenforcement of court decisions in criminal proceedings (Articles 382, 389, 3891, 390 of the Criminal Code of Ukraine ) It is proved that it has established the procedure for proper execution of sentences, rulings and decisions of the court and the punishment imposed on him. It has been established that international recognition of the systemic problem for Ukraine of non-enforcement of court decisions is not primarily concerned with criminal proceedings, but such shameful cases are beginning to gain signs of the system not least because of the problems of material criminal law. Proved that the subject of crimes related to non-enforcement of court decisions in criminal proceedings: 1) for art. 382 of the Criminal Code of Ukraine - a court decision, which has become legally effective in criminal proceedings; 2) for art. 389 of the Criminal Code of Ukraine - in the form of evasion from the payment of a fine and the serving of correctional work is the money to be paid by a convict on the verdict of the court; 3) for art. 3891 of the Criminal Code of Ukraine - an agreement on reconciliation or the recognition of guilty, the conditions of which are not fulfilled. However, if the court is satisfied that the agreement meets the requirements of the law (Part 7 of Article 474 of the CPC of Ukraine) and can be approved, it shall adopt a verdict which approves the agreement (Part 1 of Article 475 of the CPC of Ukraine) and appoints a measure agreed by the parties punishment (part 5 of Article 65 of the Criminal Code of Ukraine). Consequently, the subject of a crime is a verdict, which approved an agreement on the recognition of guilt and conditions that are not fulfilled; 4) for art. 390 of the Criminal Code of Ukraine - the subject of crime does not have, because the convict violates the terms of serving a sentence in the form of restriction of freedom or in the form of imprisonment. This procedure is established by other normative-legal acts. It was stated that the problems of crimes against justice are objectively reflected in many works of scientists, but the objective realities of the existence of Ukrainian society necessitate a new look at other elements of the syllables of crimes that violate the established procedure for the proper execution of sentences, rulings and orders of the court and its appointed punishment, forms of realization of criminal responsibility for them, as well as foreign experience of criminal law enforcement of court decisions in criminal proceedings.
