Аналіз сучасного стану та тенденції розвитку нормативно-правового регулювання державної політики у сфері національної безпеки

Abstract

Здійснено аналіз сучасного стану нормативно-правового регулювання державної політики у сфері національної безпеки та тенденцій його розвитку. З’ясовано, що сьогодні сучасна державна політика у сфері національної безпеки представлена сукупністю взаємопов’язаних нормативноправових актів, які визначають її цілі, завдання, принципи тощо і які спрямовані на регулювання суспільних відносин у сфері національної безпеки. Зроблено висновок, що сучасна державна політика у сфері національної безпеки повинна бути втілена в документі, що має не лише відповідати викликам та загрозам в умовах війни, але й стати натхненням для всієї нації. Обґрунтовано, що сьогодні державна політика у сфері національної безпеки потребує внесення корегувань з врахуванням загроз та викликів, що пов’язані з війною, а також повинна містити оцінку сучасної обстановки, ефективні механізми досягнення рішень з протидії актуальним викликам та загрозам, фінансове та матеріально-технічне забезпечення. The article deals with analysis of the current state of regulatory and legal regulation of state policy in the field of national security and its development trends. The article draws attention to the fact that, in general, the necessary legal basis for state policy in the field of national security has been formed in our country. It is noted that modern state policy in the field of national security should be comprehensive and touch all important spheres of society's life. It turns out that the strategic documents adopted in recent years, which define the state policy in the field of national security, are a significant step forward in relation to the previously existing state policy in the field of national security. Attention is drawn to the fact that modern state policy in the field of national security is far from perfect. It turns out that today's state policy in the field of national security is represented by a set of interrelated legal acts that define its goals, tasks, principles, etc. and are aimed at regulating social relations in the field of national security. It is substantiated that the legislation itself is the basis on which the entire national security system of Ukraine is fixed. And in order for it to be effective, its provisions must comply with the principles of scientific validity, consistency, relevance, and clarity. It is concluded that the modern state policy in the field of national security should be embodied in a document that should not only meet the challenges and threats in the conditions of war, but also become an inspiration for the entire nation. The modern strategy of state policy in the field of national security must take into account modern realities, as well as contain a model for the future, be accessible for perception by the nation as a whole. The article substantiates that today's state policy in the field of national security needs to be adjusted taking into account the existing threats and challenges associated with war. It is concluded that the state policy in the field of national security should include an assessment of the current situation, effective mechanisms for achieving solutions to counter current challenges and threats, financial and logistical support.
