| Короткий огляд (реферат): | Автором проаналізовано основні засади організаційно-правового змісту, щодо забезпечення реалізації права на судовий захист в умовах дії правового режиму воєнного стану. Досліджено позиції вітчизняних дослідників і учених із відповідного питання, а також думки практиків і нормативно-правове підґрунтя забезпечення доступу до правосуддя в умовах дії правового режиму воєнного стану в Україні. Охарактеризовано поняття права на судовий захист, надано характеристику його змісту та сутності, що безпосередньо впливає на здійснення правосуддя, та дотримання норм Конституції України в контексті прав і свобод людини і громадянина. Надано короткий перелік ознак, що безпосередньо притаманні відповідному інституту в Україні. Наведено основні елементи та складнощі в забезпеченні функціонування судової гілки влади в Україні в умовах дії правового режиму воєнного стану. |
| Опис: | The author analyzed the main principles of the organizational and legal content, regarding the implementation of the right to judicial protection under the conditions of the legal regime of martial law. The positions of domestic researchers and scientists on the relevant issue, as well as the opinions of practitioners and the normative and legal basis of ensuring access to justice in the conditions of the legal regime of martial law in Ukraine, were studied. The concept of the right to judicial protection is characterized, its content and essence are characterized, which directly affects the administration of justice and compliance with the norms of the Constitution of Ukraine in the context of human and citizen rights and freedoms. A short list of features directly inherent to the relevant institute in Ukraine is given. The main elements and difficulties in ensuring the functioning of the judicial branch of government in Ukraine under the conditions of the legal regime of martial law are given. It is additionally substantiated that ensuring the realization of the right to judicial protection during the operation of the legal regime of martial law in Ukraine is one of the most priority tasks in the conditions of systematic encroachment on the territorial integrity and rights and freedoms of citizens of Ukraine and persons who are in the territory of Ukraine on legal grounds. Information on attempts to legislatively settle the issue of the impossibility of administering justice in certain parts of administrativeterritorial units and taking into account the dynamics of hostilities is summarized. The role of the deputy and judicial bodies, as well as the level of their legal and legislative support for the processes of organizing the implementation of the right to judicial protection in the conditions of the legal regime of martial law in Ukraine, is singled out. It is noted that the prospect of further scientific research in the context of ensuring the realization of the right to judicial protection is the need to study the international experience of ensuring the relevant law in conditions of martial law and other emergency legal regimes. |
