| Abstract: | У статті сформульовано визначення поняття «ринок землі» та «ринок землі сільськогосподарського призначення». Виявлені елементи ринку землі, до яких належать: об’єкт, суб’єкт, зміст та мета. З’ясовані недоліки, що стосуються функціонування ринку землі сільськогосподарського призначення в Україні. Вказано, що на сучасному етапі розвитку держави варто основну увагу зосередити на розробці програмного забезпечення, що дозволить спростити роботу державним органам й нотаріусам, а також усуне корупційні ризики. Наголошено на необхідності розробки державної нормативної програми, яка буде спрямована на забезпечення ефективного землекористування. |
| Description: | The article defines the concept of «land market» as social relations that arise in connection with the ownership, use and disposal of land through the implementation of relevant civil law agreements between owners of land plots (citizens of Ukraine), legal entities of Ukraine, the state and territorial communities, as well as to other subjects – under the conditions and in the order specified in the legislation. The definition of the concept of «agricultural land market» is also formulated, it is stated that these are social relations that arise in connection with the ownership, use and disposal of agricultural land through the implementation of relevant civil law agreements between owners of land plots (citizens of Ukraine), legal entities of Ukraine, by the state and territorial communities, as well as to other subjects – under the conditions and in the manner specified in the legislation. The elements of the land market have been identified, which include: object, subject, content (rights and obligations of subjects of this legal relationship) and purpose (effective land use). Deficiencies related to the functioning of the agricultural land market have been identified: pricing of agricultural land; lack of interpretation of the meaning of the concepts used in regulatory legal acts (in particular, «sources of origin of funds or other assets»); lack of a single and sustainable strategy for the development of the agricultural land market; lack of effective legal instruments for regulating the land market. The article states that at the current stage of the state’s development, the main attention should be focused on the development of software that will simplify the work of state bodies and notaries, as well as eliminate corruption risks. The need to develop a state regulatory program aimed at ensuring efficient land use has been emphasized. |
