| Короткий огляд (реферат): | Стаття присвячена з’ясуванню особливостей структури публічного адміністрування. Визначено правову природу публічного адміністрування в демократичній правовій державі. Обґрунтовано, що така правова природа зумовлює особливості структури публічного адміністрування, яка може бути розглянута у двох аспектах. Охарактеризовано вказані аспекти. Визначено мету та місію публічного адміністрування. Охарактеризовано принципи публічного адміністрування. Запропоновано класифікацію видів публічного адміністрування за цільовим критерієм. Обґрунтовано, що публічне адміністрування можна розглядати як правовий інструмент та правову цінність. |
| Опис: | The article is devoted to clarifying the features of the structure of public administration. The arguments are given that the legal nature of public administration in a democratic state governed by the rule of law consists in the implementation by specially authorized representatives of the state and/or representatives of territorial communities elected in accordance with the established procedure, aimed at realizing the interests and needs of individuals and legal entities. This legal nature determines the peculiarities of the structure of public administration, which can be considered in two aspects. These aspects are characterized. The goal of public administration is proposed to be understood as the maximum provision of the interests of individuals and legal entities in all spheres of life of society and the state, and the creation on this basis of conditions for the sustainable development of political, economic, social, environmental, informational and other types of public relations. The mission of public administration as a structure of a higher level can be represented as building tolerant and humane relations between citizens, territorial communities, society and the state, in which an opportunity for the fullest self-realization of all members of society would be created. The principles of public administration are described. The classification of types of public administration is proposed. The thesis is substantiated that public administration can be viewed as a legal instrument, that is, a legal way to ensure the needs, interests and other intentions of individuals and legal entities by legislative and sub-legal consolidation of the status of public administrations. The article clarifies that public administration as a value is a complex of subjective reflections in human consciousness of the importance, significance and necessity of this institution for society as a whole and each individual in particular. The conclusion is made that the structure as an ordered set of certain relationships existing within phenomena and processes plays an important role in understanding the essence of public administration. Its main elements are the goal and mission of public administration, its principles and types, as well as the instrumental and value aspect of the phenomenon under study. |
