dc.description	The article emphasizes that the law obliges the investigator, prosecutor, coroner after submitting an application, notification of a criminal offense or after his own discovery from any source of circumstances that may indicate the commission of a criminal offense, within no more than 24 hours relevant information to the Unified Register of Pre-trial Investigations. It is emphasized that victims, when applying to law enforcement agencies for fraud, are often mistaken about the violation of their legal rights, and superficial consideration of such allegations leads to unjustified criminal proceedings. The specifics of fraud do not allow to immediately establish the availability of sufficient data to resolve the issue of instituting criminal proceedings, so it is clear that all information about such a criminal offense must be accepted and carefully verified by law enforcement agencies. The article examines the theoretical and practical issues of the initial stage of the pre-trial investigation, as well as offers a vision for their solution. Various views of scholars on the reasons and grounds for entering information into the Unified Register of pre -trial investigations into criminal offenses committed by fraud are considered, the problematic issues of distinguishing crime from civil tort fraud. The expediency of making changes to the criminal procedural legislation in terms of increasing the list of procedural actions that provide an opportunity to make the right decision to open criminal proceedings in the presence of signs of fraud is substantiated.	uk_UA
dc.description.abstract	Досліджено теоретичні та практичні проблемні питання початкового етапу досудового розслідування, а також запропоновано бачення щодо їх вирішення. Розглядаються різноманітні погляди вчених щодо приводів та підстав до внесення відомостей до Єдиного реєстру досудових розслідувань щодо кримінальних правопорушень, вчинених шляхом шахрайства, наголошується на проблемних питаннях розмежування злочину від цивільно-правового делікту при прийнятті рішення щодо початку досудового розслідування у провадженнях щодо кримінальних правопорушень, вчинених шляхом шахрайства. Обґрунтовано доцільність внесення змін до кримінального процесуального законодавства у частині збільшення переліку процесуальних дій, які надають можливість прийняти правильне рішення про відкриття кримінального провадження за наявності ознак шахрайства. Пропонуються оптимальні шляхи вирішення проблемних ситуацій з метою прийняття об’єктивного рішення.	uk_UA
