dc.description	The scientific article reveals the meaning of the concept of «mediation» and highlights the features of its application, taking into account the experience of foreign countries. In particular, the practice of using an alternative method of resolving legal disputes in the United States, Great Britain, Canada, Germany, Austria, Poland, etc. is considered. The practice of using the mediation procedure in Germany is interesting, in particular, the mediation procedure itself is conducted by judges. One of the most popular types of mediation is family mediation. In Austria, the mediation procedure is included in the nomenclature of professions. Canada has a special application of the mediation procedure, in particular, it first appeared in labor disputes and is required by law to resolve labor disputes. Particular attention is paid to the training of mediators in Austria, Albania, Germany and Sweden. Emphasis is placed on the requirements for a person who plans to become a mediator, in particular, among them – the age of the person, special training, registration in the register of mediators and more. Emphasis is placed on international legal regulation of the application of the mediation procedure in resolving legal disputes. The institution of mediation, as the experience of foreign countries shows, is an effective mechanism for resolving legal disputes, and the use of such a procedure helps to increase public confidence in the institution of law. Among the peculiarities of the use of mediation in dispute resolution, the following features should be singled out: 1) the use of mediation is not limited to any branch of law (its use is possible in family, labor, administrative disputes, etc.); 2) the basic principles of mediation are as follows: voluntariness, confidentiality; independence and impartiality of the mediator, etc.; 3) definition at the legislative level of requirements for persons who plan to become a mediator.	uk_UA
dc.description.abstract	Розкрито зміст поняття «медіація» та виокремлені особливості її застосування, зважаючи на досвід зарубіжних країн. Зокрема, розглянуто практику використання альтернативного способу вирішення правових спорів у США, Великобританії, Канаді, Німеччині, Австрії, Польщі тощо. Цікавою є практика застосування процедури медіації у Німеччині, зокрема, сама процедура медіації проводиться суддями. Однією із затребуваних видів медіації є сімейна. В Австрії процедура медіації внесена в номенклатуру професій. Особливості застосування процедури медіації має Канада, зокрема, вона вперше з’явилась в трудових спорах і згідно із законодавством вона є обов’язковою під час вирішення трудових спорів. Окрему увагу приділено питанню підготовки медіаторів у Австрії, Албанії, Німеччині, Швеції. Акцентовано на вимогах, що висуваються до особи, яка планує стати медіатором, зокрема, серед них – вік особи, проходження спеціального навчання, реєстрація в реєстрі медіаторів тощо. Наголошено на міжнародному нормативно-правовому регулюванні застосування процедури медіації під час вирішення правових спорів.	uk_UA
