Адміністративно-правовий аналіз суб’єктного складу формування державної політики у сфері соціальної захищеності осіб з інвалідністю

Abstract

Стаття містить адміністративно-правовий аналіз суб’єктного складу публічного управління у сфері соціального захисту осіб з інвалідністю. Визначено місце та роль публічного органу управління у сфері формування державної соціальної політики, розкрито повноваження та завдання кожного з виділених елементів у межах дослідженої проблеми. З’ясовано особливості участі Президента України як гаранта дотримання прав і свобод людини, в тому числі у формуванні засобів і позадискримінаційних шляхів реалізації цих прав, створення правового фундаменту безбарʼєрного суспільного середовища. Надано увагу повноваженню Офісу Президента України у сфері забезпечення дотримання прав і свобод, недопущення дискримінації людей з обмеженими можливостями та вадами, однією із головних завдань якого є – сприяння у продуктивній взаємодії Президента з державними органами для досягнення ефективного результату виконання напрямів державної політики, утому числі соціальної. Наголошено на здійсненні безпосереднього парламентського контролю за дотриманням прав і свобод людини та громадянина Уповноваженим Верховної Ради України з прав людини. Саме до кола прав Уповноваженого входить забезпечення виконання захисту прав осіб з інвалідністю здійсненням контролюючих заходів, шляхом відвідування, виявлення та запобігання проявів порушенню прав і свобод останніх. Проаналізовано роль консультативних органів Верховної Ради України з виділенням їх участі у формуванні державної політики, спрямованої на захист прав осіб з інвалідністю. The article contains an administrative and legal analysis of the subject composition of public administration in the field of social protection of persons with disabilities. The place and role of the public management body in the sphere of formation of state social policy is determined, the powers and tasks of each of the selected elements within the scope of the investigated problem are revealed. The peculiarities of the participation of the President of Ukraine as a guarantor of the observance of human rights and freedoms, including in the formation of means and non-discriminatory ways of realizing these rights, and the creation of a legal foundation for a barrierfree public environment, have been clarified. Attention was paid to the authority of the Office of the President of Ukraine in the field of ensuring the observance of rights and freedoms, preventing discrimination of people with disabilities and disabilities, one of the main tasks of which is to assist in the productive interaction of the President with state bodies to achieve effective results in the implementation of state policy, including social one. Emphasis is placed on direct parliamentary control over the observance of human and citizen rights and freedoms by the Human Rights Commissioner of the Verkhovna Rada of Ukraine. The scope of rights of the Commissioner includes ensuring the protection of the rights of persons with disabilities by implementing control measures, by visiting, detecting and preventing manifestations of violations of the latter's rights and freedoms. The role of consultative bodies of the Verkhovna Rada of Ukraine is analyzed, highlighting their participation in the formation of state policy aimed at protecting the rights of persons with disabilities.
