dc.description	The article proves that the definition of the system of criminal offenses that can be committed by law enforcement officers using their official powers, their grouping according to certain criteria, the development and submission of scientifically based proposals for the improvement of criminal legislation in the area of criminal liability is important for the implementation of law enforcement function of the state. It has been provided the concept of a criminal offense committed by law enforcement officer as a socially dangerous illegal act provided for by the Special Part of the Criminal Code of Ukraine, which encroaches on the rights and freedoms of a person and a citizen, property, public order, public safety, the environment, the constitutional system of Ukraine, regulated by legislation the activity of law enforcement agencies and is carried out by subjects with a special status who are serving in relevant positions and who have been assigned a special rank. It has been proposed to classify criminal offenses committed by law enforcement officers into: 1) criminal offenses in the field of official activity (by the object of the offense); 2) other criminal offenses (all criminal and illegal acts not related to the performance of official duties) (by subject of commission). Criminal offenses of the second group in most cases do not relate to the field of official activity, but are somehow related to it. First of all, this is manifested in the fact that a law enforcement officer allows himself deviations from generally accepted standards of behavior, neglects the rules of coexistence recognized by society precisely because of his belonging to the law enforcement system. Such behavior is a consequence of the existing law enforcement structures of departmental corporatism and a kind of circular guarantee, which not only do not provide for a proper assessment of the illegal actions of individual employees, but also in every way contribute to the silence of such facts and the avoidance of legal liability for the committed illegal act.	uk_UA
dc.description.abstract	У статті доведено, що визначення системи кримінальних правопорушень, що можуть вчиняти працівники правоохоронного органу, з використанням ними своїх службових повноважень, здійснення їх групування за певними критеріями, розроблення й надання науково обґрунтованих пропозицій щодо вдосконалення кримінального законодавства в частині кримінальної відповідальності має важливе значення для здійснення правоохоронної функції держави. Надано поняття кримінального правопорушення, що вчиняється працівником правоохоронного органу, як суспільно небезпечного протиправного діяння, передбаченого Особливою частиною Кримінального кодексу України, що посягає на права і свободи людини і громадянина, власність, громадський порядок, громадську безпеку, довкілля, конституційний устрій України, врегульовану законодавством діяльність правоохоронних органів та вчиняється суб’єктами зі спеціальним статусом, які проходять службу на відповідних посадах і яким присвоєно спеціальне звання. Запропоновано класифікацію кримінальних правопорушень, що вчиняються працівниками правоохоронних органів, на: 1) кримінальні правопорушення у сфері службової діяльності (за об’єктом посягання); 2) інші кримінальні правопорушення (усі кримінально-протиправні діяння, не пов’язані з виконанням службових обов’язків) (за суб’єктом вчинення).	uk_UA
