| Abstract: | У статті висвітлено проблему, з якою під час допиту стикається експерт. Огляд наявних науково-практичних джерел показав недостатню кількість інформації за цією тематикою. Складність допиту експерта полягає в тому, що суб’єкти допиту часто не обізнані у сфері знань, які має експерт, не завжди тактично готові й самі експерти. Наведено найбільш поширені ситуації та питання, що постають перед експертами під час допиту в суді. Надано науково обґрунтовані тактичні поради щодо лінії поведінки експерта на допиті в суді з урахуванням поширених на практиці способів, до яких може вдатися зацікавлена сторона. Розглянуто загальні предметно-наукові засади судової експертизи, наведено приклади запитань експерту та об’єктивних відповідей на них. |
| Description: | The article highlights the problem that the expert faces during the interrogation when asking him questions that go beyond his special knowledge and do not relate to the object of the examination. A review of available scientific and practical sources showed a lack of information on this topic, so there was an urgent need to develop practical advice to experts to confirm their opinion during interrogation, based on a generalization of the experience of interrogation of experts in courts. The difficulty of questioning an expert is that the subjects of the questioning are often unaware of the expert’s knowledge. The experts themselves are not always tactfully ready. Рresents the most common questions that experts face during interrogation in court and are intended to declare the expert’s opinion inadmissible evidence. The expert’s conclusions cannot satisfy both parties at the same time due to conflicting interests. During the interrogation, the most active party is not in favor of which the conclusion is given, seeing doubts about the professionalism of the expert. Provided scientifically sound tactical advice on the conduct of the expert during the interrogation in court, taking into account the common ways in which the interested party may resort. The general subject-scientific principles of forensic examination are considered, examples of expert questions and objective answers to them are given, the effectiveness of which has been confirmed in practice. The article is intended for forensic experts of state expert institutions. Іt is noted that to confirm the conclusion at the interrogation it is important to carefully draw it up, aggressive assertiveness of the defense during the interrogation of the expert is nullified by the quality of the examination, special knowledge, strict compliance with the law. It is emphasized that in addition to special knowledge, forensic experts should be aware of the field of law in terms of examination, expert and typical objects of research, to the extent necessary and sufficient to direct the questioning of the expert in court within the limits of law, more effectively the solution of the issues covered in the article is to provide legal support to the expert during interrogation in court by an employee of the legal department of the expert institution. |
