| Abstract: | Проаналізовано кримінальне процесуальне законодавство України та Республіки Казахстан. Вивчення праксеологічної складової захисту особи, суспільства та держави від протиправних посягань надало змогу проаналізувати відмінності в підходах щодо виявлення, розкриття та розслідування кримінальних правопорушень у кримінальних процесах наших країн. Вивчення нормативної частини, яка закріплена в міжнародних конвенційних, національних конституційних, галузевих нормах права, дало змогу сформувати відмінності, тотожності, перелічені висновки, та стати основою для подальшого наукового пошуку. Також були сформовані пріоритетні пропозиції щодо посилення гарантій правомірності обмеження права особи на свободу та особисту недоторканність. |
| Description: | The article deals with analysis the criminal procedural legislation of Ukraine and the Republic of Kazakhstan. The study of the praxeological component of the protection of the individual, society and the state from unlawful encroachments made it possible to analyze the differences in approaches to the detection, desclosure and investigation of criminal offenses in the criminal proceedings of these countries. The study of the regulatory part, which is enshrined in international convention, national constitutional, sectoral rules of law, made it possible to form differences, identities, listed conclusions, and become the basis for further scientific research. Priority proposals were also made to strengthen guarantees of the legitimacy of restrictions on an individual’s right to liberty and security. The causality and regularities of incorrect, unjustified taking of measures restricting a person's rights to freedom and personal inviolability on specific practical examples have been revealed. A comparative analysis of the criminal procedural legislation of Ukraine and Kazakhstan, as well as the rules of international convention law that affect the solution of practical issues has been made. The praxeological aspect of the admissibility of factual data obtained in excess of the established time limits is based on the temporal structure of procedural coercion measures Both countries are invited to adopt the positive experience of the British Custody Records model in order to eliminate possible contradictions in the observance of the procedural form of detention by the police and the prosecutor's office. |
