| dc.description | The article attempts to consider the key characteristics of the «society of impressions», which set the social framework for the transformation of the theoretical understanding of right within the postmodern paradigm. Rapid social changes taking place in society today are described by concepts: concepts / metaphors as emotions, performance (including performance of justice), impressions, dramatization, spectacular visualization, emotionality, virtuality. The nature of the current transformations is completely unclear, in the theoretical scientific discourse we are talking about: information, visual, technological revolution. The main features of the society of impressions are the dominance of plurality, situationality, lack of hierarchical order, constant «fluidity» of social and virtualization. Virtual reality is becoming increasingly important in the life of the individual and society as a whole. It is this reality that gives rise to new meanings of law and the possibility of solving the problems of legal rationalism, obedience to the law, the desire for responsibility, individual and group unity. Modern rights is being transformed along with social change. Critical legal research, feminist theory of law, and semiotic theory of law are emerging and gaining popularity. Modern theorists of law recognize that there is a paradigmatic change: from traditional truths to immaterial, pluralistic, contextual definitions of law, and thus from legal justice to creative justice. Law is only a culturally conditioned discursive form. The theory and practice of modern liberal law is based on the concept of language, according to which words and concepts can adequately and objectively convey the meaning of events. Professional legal language uses abstract concepts, such as object, subject, law, society, and builds legal norms on them. In a society of impressions, the criteria of rationality are blurred, because there are groups of the population who have their own assessments of the situation, government preferences and needs. | uk_UA |
| dc.description.abstract | У статті здійснено спробу розглянути ключові характеристики «суспільства вражень», що обґрунтовують соціальну межу трансформації теоретичного розуміння права в межах постмодерністської парадигми. Стрімкі соціальні зміни, що відбуваються в наш час у суспільстві описують концептами: поняття/метафори як емоції, cпектакль (у тому чиcлі й cпектакль судочинства), враження, театралізація, видовищна візуалізація, емоційніcть, віртуальність. Характер поточних перетворень до кінця незрозумілий. У теоретичному науковому дискурсі мова йде про: інформаційну, візуальну, технологічну революції. Сучасне право трансформується разом із суспільними змінами. Виникають нові простори для реалізації права, зокрема віртуальний. З’являються та набувають популярності критичні правові дослідження, феміністська теорія права, семіотична теорія права. З огляду на тектонічні суспільні зміни різнорідного порядку, сучасні теоретики права визнають, що відбувається парадигмальна зміна: від традиційних істин до нематеріалістичних, плюралістичних, контекстуальних означень права, а відтак від легального правосуддя до правосуддя творчого. | uk_UA |
