| Короткий огляд (реферат): | Досліджено побудову криміналістичної характеристики правопорушень проти моральності. Криміналістична характеристика правопорушень є категорією досить динамічною, тобто може змінюватись залежно від конкретних умов дійсності. Водночас її безпосереднє застосовування може мати різні напрямки у діяльності працівників правоохоронних органів. Для прикладу, за ознаками способу, місця та часу вчинення правопорушення може бути висунута версія щодо особи правопорушника, і навпаки, під час його затримання та в разі наявності даних щодо обставин протиправного діяння може бути побудовано версію про вчинення цією особою інших, ще не розкритих кримінальних правопорушень. Тобто знання криміналістичної категорії конкретного протиправного діяння надає додатковий інструментарій працівникам правоохоронних органів під час реалізації кримінальних проваджень різноманітних категорій. |
| Опис: | The article contains the research of the construction of forensic description of offenses against morality. The author emphasizes that the forensic description of offenses is a rather dynamic category. In other words, it may change depending on the specific conditions of reality. At the same time, its direct application may have different directions in the activity of law enforcement officers. For example, according to the method, place and time of its act, a version concerning the person of the offender may be proposed, and vice versa, if it is detained and in the presence of data on the circumstances of the unlawful act, a version of the act of that person other, not yet disclosed criminal offenses may be constructed. That is, knowledge of the criminal category of a particular unlawful act gives additional tools to law enforcement officials during the implementation of criminal proceedings of various categories. It has been noted that the forensic description is a system of information about the criminal significant signs of unlawful acts, which reflects the legal relations between them, serves to build and check the investigative versions to solve the main tasks of the investigation. On the basis of the research conducted, the criminal characterization of offenses against morality was classified as follows: 1) the speech and personal rights of citizens (art. 297-300 CC of Ukraine); 2) sexual relations (art. 301-303 CC of Ukraine); 3) activities of persons who have not reached adulthood (p. 4 art. 301, part 3-4 of the art. 302, part 3-4 of the art. 303, art. 304 CC of Ukraine). The author has noted that each of the above groups has its own specific content. In particular, the first group identified the following elements: the way of criminal offense, the situation of criminal offense, the blind picture, the subject of offense, the person of the offender. In the second group is allocated: the way of criminal offense, the situation of criminal offense, the blind picture, the person of the offender. And in the third group, such elements as the way of criminal offense, the situation of criminal offense, the blind picture, the person of the victim, the person of the offender. |
