| Короткий огляд (реферат): | У статті проведено аналіз статті 369-3 КК України та Закону України «Про запобігання впливу корупційних правопорушень на результати офіційних спортивних змагань» № 743-VIII від 03.11.2015. За результатами дослідження встановлено, що у законодавця були всі обов’язкові обставини соціальної зумовленості для створення кримінально-правової норми, яка має на меті убезпечити суспільство від протиправного впливу на результати офіційних спортивних змагань. |
| Опис: | According to Art. 3 of the Constitution of Ukraine, human rights and freedoms and their guarantees determine the content and orientation of the state’s activities. The state takes care of the development of physical culture and sports (Article 49). Based on the basic law of the country, the Verkhovna Rada of Ukraine adopted the Law of Ukraine “On Preventing the In¤uence of Corruption O¥enses on the Results of O¦cial Sports Competitions” № 743-VIII of November 3, 2015. This Law is aimed at preventing the impact, responsibility and responsibility for the results of o¦cial sports competitions of corruption o¥enses and violations related to corruption in the §eld of sports, de§nes the principles, peculiarities of the subjects and measures of prevention and detection of the said violations. Also, this legal act provided for the introduction of Article 369-3 in the Criminal Code of Ukraine, entitled “Illegal in¤uence on the results of o¦cial sports competitions”. Adoption of the Law of Ukraine “On Preventing the Impact of Corruption O¥enses on the Results of O¦cial Sports Competitions” and amendments to the Criminal Code of Ukraine see considerable attention to the issue of corruption in sport by the legislative branch of the Ukrainian authorities. Thus, according to the Uni§ed Report on Criminal O¥enses by the State Prosecutor General’s O¦ce of Ukraine, for 2015 there are no registered criminal proceedings under Art. 369-3 of the Criminal Code of Ukraine. In 2016, two criminal proceedings were registered. In 2017 again, there are no registered criminal proceedings. In 2018 3 criminal proceedings were registered (two persons were noti§ed of suspicion). For the period January–October 2019, two criminal proceedings were registered. During the existence of Art. 369-3 of the Criminal Code of Ukraine 7 criminal proceedings were registered and two persons were noti§ed of suspicion. There is no information on sentenced persons. In the article we were able to conclude that the legislator had all the necessary circumstances of social conditionality to create a criminal law, which is intended to protect society from the illegal in¤uence on the results of o¦cial sports competitions. At present, we have no reason to argue that the unlawful in¤uence on the results of o¦cial sports competitions does not extend, but only indicates that there are currently subjective problems of criminal law provision of this norm, which require further scienti§c research. We can also assume that this criminal o¥ense, including a number of wrongdoing o¥enses, is characterized by a high level of latency, since both parties are usually interested in secrecy. |
