| Короткий огляд (реферат): | Наведено авторське визначення поняття «муніципальний контракт». Досліджено зарубіжний досвід його успішного використання та обґрунтовано доцільність впровадження в українську практику державного управління та місцевого самоврядування. Розкрито сутність структурних елементів муніципальних контрактів, зокрема ціль; предмет; об’єкт; термін дії контракту; пріоритетний інвестиційний план; план покращення ресурсного забезпечення місцевих бюджетів; муніципальний план технічного обслуговування; план державного регулювання або програма реформи; умови контракту; права та обов’язки сторін. Розроблено механізм його формування, укладання та виконання. |
| Опис: | Municipal contract has emerged as a tool to facilitate financial support of territories projects development. It aims at increasing decentralization and participation of local-self authorities and community members in solving local problems. This will give a powerful impetus to local budgets resource support management. In this article the author's definition of "municipal contract" is developed. The international experience of its use is studied. The expediency of implementation of municipal contracts in the Ukrainian practice of public administration is proved. Municipal contract is an agreement between local-self governments and public authorities to provide public financial support for projects of local significance on the fixed conditions and is obligatory for execution. The basic structural elements of municipal contracts: the goal; subject and object; validity of the contract; priority investment plan; resources improvement plan to ensure local budgets; municipal maintenance plan; government regulation plan or program reform; contract terms; rights and obligations of the parties are determined in the article. Also, the mechanisms of formation, conclusion and implementation of municipal contracts are developed. A contract is developed based on the characteristics of the local community, including organizational and financial capabilities and weaknesses. Municipal contract is a new tool in tide management of public financial resources for Ukraine. Its implementation will contribute to the solution of the problems of transfer dependence of local budgets from the state budget. This fully corresponds to the postulates of decentralization of power. |
