| Опис: | At present, there is no law in Ukraine regulating the circulation of non-military weapons available for acquisition, storage, use and possession by Ukrainian citizens. All these issues are resolved at the level of regulations. Since there are heated discussions in Ukraine about the expediency of providing citizens with weapons of self-defense, there are ongoing social sections of citizens’ opinions on this issue, systematically, but very slowly, legislative work in this area is underway. The article finds out that there are weapons of self-defense and how Ukrainian citizens understand it, and the sociological needs of Ukrainian citizens in the free possession of weapons have been determined. The present state of legal provision for the realization of the right of citizens to own self-defense weapons and the prospects for its improvement is determined. It is revealed that weapons of self-defense are weapons that can be used and used by Ukrainian citizens to protect their lives and health, family members, their own property, as well as other Ukrainian citizens from armed or armed attack; its legal status in Ukraine is not defined. At the same time, the law regulates the concept of civilian weapons that is available for purchase and which can be used as a weapon of self-defense within the framework of the necessary defense in accordance with Art. 36 of the Criminal Code of Ukraine. It is concluded that today in Ukraine, in order to legalize the free circulation of weapons for the purpose of self-defense, it is necessary to fulfill a number of requirements: definition and observance of the boundaries of necessary defense; studying and obtaining permission to purchase weapons only after passing the exam; definition of the category of citizens who can not have such a right; to provide highquality and timely state control over the circulation of weapons. |
