Abstract: Проаналізовано правовий статус прокурора у цивільному судочинстві України, як реалізацію принципу публічності в цивільному процесі. Розглянуто питання юридичної природи представництва прокурором, а також його процесуальної форми як самостійного інституту цивільного процесуального права.
The article deals with analysis of the legal status of the prosecutor in the civil legal proceedings of Ukraine, as the implementation of the principle of publicity in the civil process. The article deals with the legal nature of the representation of the prosecutor, as well as its procedural form as an independent institute of civil procedural law. The task of the prosecutor in carrying out the representation of the interests of citizens in civil legal proceedings defines the protection of the rights and legitimate interests of citizens and the state, as well as assistance in complying with the requirements of the law on comprehensive, complete and objective consideration of cases and the adoption of court decisions based on the law, guided by this the principles of legality, independence of judges, equality of individuals before the law and the court. Representation by the public prosecutor's office of the interests of a citizen or state in a court is the execution of prosecutors on behalf of the state procedural and other legal actions aimed at protecting the interests of a citizen or state in court in cases provided for by law. The role of the prosecutor in civil legal proceedings is clarified, which is crucial in ensuring the rights and legitimate interests of citizens and the interests of the state. The prosecutor's role of representing the interests of a citizen or a state in court is an important guarantee and form of realization of the constitutional right of everyone to protect their rights. Particular attention is paid to the study of the purpose and task of the prosecutor's representation in the civil process, based on the fact that the purpose is to protect the rights of individuals, interests of the state that are violated, unrecognized or challenged, and the task of using in civil judicial proceedings measures to restore violated rights and legitimate interests of the citizen and the state, elimination of the causes and conditions that contributed to their violation.
