Abstract: Визначено актуальність та сформовано напрямки вирішення проблеми криміналістичного забезпечення подолання протидії кримінальному судочинству. Наголошено, що наявність чітких науково вивірених й апробованих практикою рекомендацій з криміналістичного забезпечення подолання протидії кримінальному судочинству полегшить досягнення позитивних результатів у боротьбі з розглядуваними проявами взагалі та покращення криміногенної обстановки в нашій державі зокрема.
The article is devoted determination of actuality and forming of directions of decision of problem of the criminalistics providing of overcoming of counteraction the criminal legal proceeding. It is marked, that one of constituents of decision of this task is optimization of process of investigation and increase of efficiency of overcoming of counteraction from the side of criminals and other persons of not interested in establishment of objective truth in criminal realizations. Workers of law enforcement authorities which run into the displays of counteraction from the side of the interested persons during investigation unable to contrast the deserving complex of actions. About it testify, resulted in the articles, statistical information of the General prosecution of Ukraine, in obedience to which suspicion is declared less than after third of facts of perfect criminal offences. In good time not attracted and those which avoided responsibility perfect criminal acts, continue the feasance of more heavy and impertinent publicly dangerous acts including with application of modern hardwares, measures of preparation, elimination, disguise, or falsification of information, stagings, and others like that. Among reasons which negatively influence on implementation of tasks of criminal code of practice of Ukraine is, including, scientific under exploitation and absence of effective recommendations for investigators, which during investigation, and judges – during a judicial trial run into the displays of counteraction from the side of the interested persons. In addition, there is a row of objective and subjective factors, through what workers of law enforcement authorities assume substantial miscalculations and errors in the estimation of displays of counteraction and ways of its overcoming. Absence in theory of developed and the practically approved complexes of measures on overcoming of counteraction the criminal legal proceeding negatively influences not only on the state of investigation and warning of criminal offences but also on the high level of their latentness. It is marked that the presence of the clear recommendations scientifically adjusted and approved practice from the criminalistics providing of overcoming of counteraction the criminal legal proceeding will facilitate achievement of positive results in a fight against the examined displays in general and improvement of crime situation in our state in particular.
