| Короткий огляд (реферат): | У статті проаналізовано підходи до визначення терміна «держава-сателіт». На цій основі зроблено висновок, що визначення «держава-сателіт» не має усталеної інтерпретації. Метою роботи є теоретико-правовий аналіз поняття «держава-сателіт», виявлення різних підходів до розуміння різних форм клієнтської державності. Запропоновано розмежування в інтерпретації цих форм. Подано авторський варіант поняття «держава-сателіт», а саме: особливої форми наддержавних відносин держави, що пов’язана з іншою своїм зовнішньополітичним курсом, внаслідок нав’язаного їй антидемократичного політичного режиму. |
| Опис: | The article analyzes the approaches to the definition of the term «satellite state». On this basis, it is concluded that the definition of «satellite state» has no established interpretation. The aim of the work is theoretical and legal analysis of the concept of «satellite state», identification of different approaches to understanding different forms of client statehood. A distinction is proposed in the interpretation of these forms. The author’s version of the concept of «satellite state» is presented as: a special form of supranational relations, a state that is connected with another in its foreign policy, due to the imposed anti-democratic political regime. The aim of the work is theoretical and legal analysis of the concept of satellite state and understanding of various forms of client statehood. The theoretical basis of the work was the author’s previous work on the designated topics: «Understanding that classification of quasi-powers»; «The real sovereignty of the state in the minds of globalization»; «Protectorate: approach to interpretation»; «The modern management of the power in the context of the problem of sovereignty»; «Associated State». The term satellite state today does not have a single established interpretation and is often used to describe a formally independent state that is de facto under the political and economic influence of another more powerful and developed state. The above-mentioned forms of client dependence are often equated with unrecognized or partially recognized states, the existence of which can be considered in the context of modern problems of international relations. Undoubtedly, the sovereignty of unrecognized or partially unrecognized states, which is formally or partially not recognized by other states, the international community for certain legal or political reasons, undermines their status as subjects in the international arena. In our opinion, such an approach is incomplete, because it not only contradicts the features that determine the legal personality of states in international public relations, formed in accordance with the declarative theory of statehood of the Montevideo Convention, but also does not give grounds for their clear differentiation, appealing only to one possible sign – the fact of international recognition. The interpretation of the concept of «satellite state» does not seem possible without clarifying the essence of other related definitions: puppet state, tributary state, client state, vassal state, The client state has a broad interpretation and is used to define varying degrees of dependence, which implies economic, political or military subordination to another more powerful state. A puppet state is an extreme form of dependence of a formally sovereign state, which has only nominal sovereignty, is externally controlled in political, financial, economic and military activities, but is able to maintain control over local government. The satellite state is linked to another by its foreign policy as a result of the anti-democratic political regime imposed on it. The tributary state is a historical form of dependence that involves regular sending of tribute in its real, or (later) formal sense. Almost identical in content is the understanding of the vassal state, the degree of dependence and preferences, which was determined not only by paying tribute, but also by military support (service) in favor of the supreme suzerain. |
