| Короткий огляд (реферат): | У статті вивчено співвідношення категорій «слідча ситуація» та «ситуація протидії» досудовому розслідуванню. Стверджується, що в раніше здійснених науковцями дослідженнях слідчої ситуації, з боку науковців, не приділялось належної уваги ситуаціям протидії. Аналізуючи погляди вчених щодо слідчої ситуації, наголошується, що всі вони тією чи іншою мірою визначаються з позиції умов (обстановки) розслідування. Зосереджується увага, що наведені позиції можна сприймати, як синонімічне, близьке за визначенням змістовне наповнення досліджуваної наукової категорії, яка на початковому етапі розслідування може розглядатись з позиції ступеня поінформованості уповноваженої особи про обставини кримінального правопорушення взагалі й особу злочинця зокрема. У висновках наголошується на необхідності, з одного боку, окреслення ситуацій протидії, з іншого – нерозривного розгляду їх та вирішення разом із слідчими ситуаціями. |
| Опис: | The article conducts a study of the relationship of categories «Investigative situation» and «Situation of opposition» to pre-trial investigation. It is alleged that in earlier research conducted by scientists, the investigative situation was not given due attention to situations of counteraction. Analyzing the views of scientists on the investigative situation, it is noted that all of them to some extent determined from the point of view of the conditions (situation) of the investigation. The focus of attention is that the above-mentioned positions can be perceived as synonymous, close to the definition of the content of the examined scientific category, which, at the initial stage of the investigation, can be considered from the point of view of the authorized person’s knowledge of the circumstances of the criminal offence in general and the offender in particular. It is emphasized that on the one hand, the set of actions (inaction) are not interested in the investigation of persons, are not per se a «situation of counteraction», but only determine its formation. On the other hand, it is not correct, in our opinion, to assert unconscious overcoming of opposition which the authorized person did not realize without experiencing difficulties in his activity. The article points out that not only the information collected on the relevant production, but also the data contained in the forensic characterization of the scientific research in the relevant area, are important in the knowledge of the authorized person. Their examination, comparison and analysis may influence the authorized person’s assessment of the available body of information and determination of the direction of searching for the information not yet found. The author’s opposition to the investigation is assessed as a set of actions (omissions) aimed at increasing the ability of law enforcement agencies to carry out activities aimed at achieving the objectives of the Code of Criminal Procedure. Thus, the investigative situation as a scientific category cannot cover the conditions for opposing the pre-trial investigation. The content of the article emphasizes that the inclusion in the category of «investigative situation» of conditions that will characterize the manifestations of counteraction, will lead to the complexity of theoretical and practical application. This led to the introduction of such scientific category as «situation of counteraction» The conclusions point to the need, on the one hand, to identify situations of opposition, on the other, to consider them seamlessly and to resolve them together with investigative situations. |
