| dc.description | The article is devoted to the consideration of the object of the criminal offense in the form of violation of the right to free medical care. It is emphasized that today in the science of criminal law there are three most common approaches to determining the object of a criminal offense: «object – public relations», «object – the most important social benefits» and «object – social values». The position is supported, according to which the object of any criminal offense is the most important public relations protected by the law on criminal responsibility, which are encroached upon by the subject of the crime or criminal offense. The position was supported, according to which under the main direct object of the criminal offense under Art. 184 of the Criminal Code of Ukraine, it is appropriate to consider, in a broad sense, public relations that ensure the health of the citizen, and in a narrow sense – public relations that ensure the right to free medical care. The essence of the right to health care is a complex multidisciplinary category that needs to be regulated in the national legislation of Ukraine. It is proved that the essence of the right to health care is as follows: 1) it is the power regulator of social relations between the subjects in the field of health care; 2) it is an indicator of freedom and equality in society regarding the use of the achievements of medical science; 3) it is aimed both at meeting private needs in the field of health care and at meeting public interests through a reasonable compromise between these guidelines. | uk_UA |
| dc.description.abstract | Розглянуто об’єкт складу кримінального проступку у вигляді порушення права на безоплатну медичну допомогу. Підтримано позицію, відповідно до якої об’єктом складу будь- якого кримінального правопорушення є поставлені під охорону закону про кримінальну відповідальність найбільш важливі суспільні відносини, на які посягає суб’єкт злочину або кримінального проступку. Запропоновано під основним безпосереднім об’єктом складу кримінального правопорушення, передбаченого ст. 184 КК України, розглядати, у широкому розумінні, суспільні відносини, що забезпечують право на охорону здоров’я громадянина, а у вузькому – суспільні відносини, що забезпечують право на безоплатну медичну допомогу. | uk_UA |
