| Короткий огляд (реферат): | Законодавство не містить чіткого переліку кримінальних правопорушень, яким протидіє Державна прикордонна служба України. Тому під час їх встановлення ми виходили з нормативної основи діяльності ДПСУ, аналізуючи види кримінальних правопорушень, протидія яким здійснюється ДПСУ, крізь призму функцій та співставленні їх із завданнями та повноваженнями прикордонного відомства. Під час дослідження встановлено, що окремі з функцій безпосередньо вказують на протидію кримінальній деліктності, інші – хоча і опосередковано, але їх виконання в підсумку спрямоване на протидію кримінальним правопорушенням. |
| Опис: | The purpose of the article is to determine the types of criminal offenses counteraction to which is committed by the State Border Guard Service of Ukraine by analyzing the functions of the border agency. There is no a clear list of criminal offenses in legislation to which the State Border Guard Service of Ukraine counteracts. Therefore, when determining them, the author made conclusions from the normative basis of the activities of the SBGS, analyzing the types of criminal offenses that are countered by the SBGS, through the prism of functions and comparing them with the tasks and powers of the border agency. In the course of the study it was established that some of the functions directly indicate the prevention of criminal delinquency, while others – albeit indirectly, but their implementation is ultimately aimed at prevention of criminal offenses. It was proposed to distinguish the main and related criminal offenses, which are countered by the SBGS. The main criminal offenses include separate criminal offenses against the foundations of Ukraine’s national security; in the field of inviolability of state borders; against the established order of moving certain goods/items across the state border of Ukraine; against the environment; against the established procedure for entering and leaving the temporarily occupied territory of Ukraine; against public safety; against the authority of state authorities; against social relations in the sphere of maintenance of normal interstate relations, which ensure peaceful cooperation of states, etc. Concomitant criminal offenses are criminal offenses in the field of official activity; against the established order of circulation and use of documents; against the life and health of a person; against the order of economic activity established with the aim of countering the involvement of ―dirty‖ funds in the economic activity. In the course of assessing the compliance of the state of regulatory support for the activities of the SBGS in relation to combating criminal offenses to the challenges and threats caused by war and the social phenomena accompanying it, it was established that the scope of powers granted to the SBGS on defense of the state does not correspond to the content of its functions. In view of this, it is proposed to specify the defense function of the SBGS, which regulates the preventive activities of the SBGS regarding criminal offenses against peace, human security, and the international legal order, and against the foundations of Ukraine’s national security in the course of state defense. |
