Краткий осмотр (реферат): З‘ясовано спільні та відмінні риси в конституційному регулюванні порядку внесення змін до конституцій України й окремих пострадянських держав. На основі виконаного порівняльного аналізу конституцій України, Республіки Білорусь, Грузії, Республіки Естонії та Республіки Казахстан визначено спільні й відмінні риси конституційного регулювання внесення до них змін за такими критеріями: 1) ініціатори внесення змін до Конституції; 2) форми участі громадян у процесі внесення змін до Основного закону; 3) органи, уповноважені здійснювати контроль за конституційністю внесення змін до Конституції; 4) питання, з яких не допускається внесення змін до Конституції, та умови, за яких заборонено внесення таких змін; 5) органи (суб‘єкти), що наділені правом ухвалювати рішення про внесення змін до Основного закону. Доведено, що конституційний процес (у вузькому розумінні) є складовим елементом законодавчого процесу, має повну назву «законодавчий конституційний процес» і становить систему послідовних стадій (дій). Запропоновано внесення змін до ст. 69 та 157 Конституції України.
Описание: The authors have aimed to clarify the common and distinctive features in the constitutional regulation of the procedure for amending the constitutions of Ukraine and some post-Soviet ccounries. Based on the results of a comparative analysis of the constitutions of Ukraine, the Republic of Belarus, Georgia, the Republic of Estonia and the Republic of Kazakhstan, common and distinctive features of the constitutional regulation of amendments to them have been identified according to the following criteria: 1) initiators of amendments to the Constitution; 2) forms of citizen participation in the process of amending the Fundamental Law; 3) bodies authorized to exercise control over the constitutionality of amendments to the Constitution; 4) issues on which amendments to the Constitution are not allowed, and conditions under which such amendments are prohibited; 5) bodies (entities) that have the right to make decisions on amendments to the Fundamental Law. It has been proved that the constitutional process (in the narrow sense) is an integral part of the legislative process, has the full name «legislative constitutional process» and consists of a system of successive stages (actions). There is the author's definition of the term «legislative constitutional process». It is a legally significant activity of the Ukrainian people and the Parliament of the state determined by national rules, which is a system of interconnected successive stages aimed at regulating public relations to change, abolish or create legal rules objectified in the Fundamental Law of the state. «It is proved that this aspect of the legislative constitutional process is generally regulated at the level of the Constitution of Ukraine and legislative acts. At the same time, modern European integration processes and the development of the state as a democratic and legal one require the improvement of this procedure, in particular in terms of wider involvement of civil society actors in this process. Краткий осмотр (реферат): Метою статті є визначення специфіки політичних та конституційно-правових процесів, пов‘язаних з декомунізацією в країнах Центральної Азії (Казахстан, Узбекистан, Киргизстан, Туркменістан, Таджикистан), дослідження варіативності основних напрямів пострадянських трансформацій відповідних суспільств. У кожної з п‘яти держав Центральної Азії є свої унікальні особливості, але жодна з них не побудувала громадянське та демократичне суспільство. Цивілізаційні та локально-культурні особливості роблять цінності громадянського суспільства малопривабливими не лише для політичних еліт, а й для більшості населення, тому найближчим часом навряд чи варто очікувати суттєвих зрушень у цьому напрямі. Крім того, центральноазійські країни перебувають під впливом трьох потужних регіональних лідерів – Росії, Китаю та Ірану – чиї культурно-історичні цінності також доволі далекі від ліберально-демократичних цінностей Заходу. Ситуацію ще більш ускладнює чинник ісламського фундаменталізму, який майже напевне посилиться після перемоги талібів в Афганістані.
Описание: The aim of the article is to determine the specifics of political processes related to decommunization in Central Asia (Kazakhstan, Uzbekistan, Kyrgyzstan, Turkmenistan, Tajikistan), to study the variability of the main vectors of post-Soviet transformations of the respective societies. Reforms in Kazakhstan could theoretically pave the way for civil society, but so far they are more of an imitation. Uzbekistan is distinguished by the state's struggle against Islamic fundamentalism, which gave rise to Islam Karimov to pursue a tough internal policy. Democratization shifts after his death, but the prospects and irreversibility of these reforms are now highly questionable. Kyrgyzstan is the only society in which civil protest has real force, but the presence of clan-patriarchal system, ethnic conflicts, the tendency to use force and the weakness of the central government do not allow building a civil society in this country. Turkmenistan is characterized by boundless authoritarianism, and Tajikistan is the only country that has survived a fierce civil war in which the Islamic religion is most powerful. Each of the five Central Asian states has its own unique characteristics, but none of them has built a civil and democratic society, and the transformation cause of political regimes into democracies remains at the level of rhetoric. In these countries, political alterations have affected mainly the area of institutions, without changing the semi-feudal procedures and practices, and the process of democratization itself has been limited to pseudo-reforms. Civilizational and local-cultural features make the values of civil society unattractive not only for political elites, but also for the majority of the population, thus in the near future we can hardly expect significant progress in this direction. Moreover, Central Asian countries are under the influence of three powerful regional leaders – Russia, China and Iran – whose cultural and historical values are far from Western liberal-democratic ones. Краткий осмотр (реферат): У статті проаналізовано сучасний стан дотримання прав людини в Україні та рейтинги/ренкінги нашої держави в різноманітних рейтингах, що стосуються прав людини; розглядаються формальні (державні) та неформальні (громадянське суспільство) структури, які діють у полі правозахисної діяльності, зокрема, діяльність Уповноваженого Верховної Ради з прав людини, спеціалізованих уповноважених Президента, правозахисних організацій та акцентовано на їх взаємодії. Розглянуто позаорганізаційний рівень правозахисту, а саме індивідуальні практики українців із захисту прав людини та на підставі аналізу результатів загальноукраїнських соціологічних досліджень визначені методи та ефективність такого формату правозахисту.
Описание: The situation with human rights violations in modern Ukraine remains quite acute, as evidenced by various sources at both the international and national levels, official and alternative. In such circumstances, human rights activities are of paramount importance. In the modern human rights field, formal (state) and informal (civil society) structures coexist, and rarely interact. A powerful tool in resolving systemic issues related to human rights is the institution of the ombudsman, represented by the Verkhovna Rada Commissioner for Human Rights and the President's specialized commissioners. The informal level is represented by non-governmental human rights NGOs, of which there are currently more than a hundred in Ukraine. They act as organized, structured, registered, etc. associations that work to promote and protect human rights and freedoms, to establish and maintain effective control over the observance of those freedoms and rights by the state, its bodies and officials. To achieve that, human rights organizations work simultaneously in such areas as the protection of human rights in specific cases (advocacy); dissemination of information on human rights, legal education work; analysis of the state of observance of human rights. As it was before, NGOs have different amounts of resources (background, experience, power, influence), depend on funding from foreign donors and compete with each other. One of the main resources for improving the effectiveness of the human rights field is the cooperation of the ombudsman with nongovernmental organizations and the public. An example of cooperation is the model of Ukrainian National Preventive Mechanism (NPM), which has been operating in Ukraine since 2012 to prevent torture, although the format of this interaction has been criticized by experts in the context of the limited role of the public. The nonorganizational level is represented by the individual practices of Ukrainians in the protection of human rights, the volume of which is increasing, but the efficiency remains low.2021-01-01T00:00:00Z
