| Короткий огляд (реферат): | Висвітлено окремі аспекти обмежень, що були накладені державами на громадян в умовах пандемії COVID-19, на основі аналізу положень міжнародно-правових актів, та практики Європейського суду з прав людини. Автори акцентують увагу на тому, що перед Європейським судом з прав людини вже сьогодні постала необхідність прийняття рішень по справам щодо порушення прав людини під час медичного втручання в умовах пандемії. У статті зазначено, що пандемія є тією надзвичайною ситуацією, коли можливі відступи від прав людини. При цьому, як зазначають автори, ЄСПЛ вважає необхідними процедурні обмеження відповідних способів медичного втручання, наголошуючи на загальнообов‟язковому забезпеченні дотримання прав людини, гарантованих Конвенцією. |
| Опис: | The article highlights certain aspects of restrictions imposed by states on citizens in the context of the COVID-19 pandemic, based on an analysis of the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, the Syracuse Principles for Interpretation of Limitations and Derogations political rights, the Convention on Human and Civil Rights. In addition, the author focuses on the analysis and evaluation of the established and current case law of the European Court of Human Rights on medical intervention, as well as the practice of obligations imposed on citizens during the COVID-19 pandemic. The authors emphasize that the European Court of Human Rights has already faced the need to make decisions on cases of human rights violations during medical intervention in a pandemic. In this regard, it is urgent to answer a number of questions, including: were these restrictions necessary in the current situation? Are the individual measures taken proportionate to the situation? Does the adopted emergency legislation comply with the provisions of the Convention? The authors believe that the study of these issues will form a quality health policy, balancing between private and public interests in Ukrainian society. The article states that a pandemic is an emergency situation where deviations from human rights are possible. However, according to the author, the European Court of Human Rights considers it necessary to limit procedural restrictions on the relevant methods of medical intervention, emphasizing the mandatory protection of human rights guaranteed by the Convention. Therefore, the rights of the individual cannot be considered in isolation, recognizing the priority of the rights of the individual does not mean ignoring the interests of others, indulging in the abuse of rights. And since the scale and severity of the COVID-19 pandemic pose a threat to public health, the restriction of rights and freedoms is justified under current European Court of Human Rights practice. |
