| dc.description | The article is devoted to the consideration of problematic issues of legislative definition of types and sizes of punishments in the norms of the Special Part of the Criminal Code of Ukraine, taking into account the expediency of introducing restorative justice measures into the legislation of Ukraine. In the system of types of punishments provided by the criminal legislation of Ukraine, the most severe are imprisonment for a definite term and life imprisonment. In Ukraine, imprisonment remains one of the main means of preventing criminal offenses. Establishing the optimal size of sanctions of criminal law should take into account numerous factors (the degree of public danger and prevalence, objective and subjective signs of a criminal offense, the degree of public danger of the offender, the level of public awareness, which reflects social justice and expediency). The current criminal legislation of Ukraine does not have a clearly agreed system of sanctions imposed for encroachments on various tribal and direct objects, for intentional and negligent criminal offenses, in general and special rules. An important measure that can affect the effectiveness of Ukraine’s criminal law policy in determining the types and sizes of punishment is the widespread introduction of elements of restorative justice, which is based on the refusal to impose sanctions for criminal offenses, minor and serious crimes. In the context of introducing elements of restorative justice into the legislation and jurisprudence of Ukraine, it is advisable not only to refuse to apply imprisonment for certain types of criminal offenses, but also to apply short terms of imprisonment (one to two years) for serious and especially serious crimes. with intentional infliction of grievous bodily harm or death. | uk_UA |
| dc.description.abstract | Розглянуто проблемні питання законодавчого визначення видів та розмірів покарань у нормах Особливої частини КК України з урахуванням доцільності запровадження у законодавство України заходів відновного правосуддя. Обґрунтовується недостатній рівень системного підходу до узгодження санкцій у нормах, що передбачають відповідальність за кримінальні правопорушення тотожні за об’єктом посягання, формою вини, видами та розмірами суспільно небезпечних наслідків. Запропоновано на законодавчому рівні закріпити заходи, спрямовані на долучення України у кримінально-правовій політиці до відновного правосуддя. | uk_UA |
