| dc.description | Gender as political and legal guide in the labor sphere is studied in the article. Special attention is focused on the fact that the issue of gender equality is currently relevant among scholars. But there is a large number of debatable issues regarding gender equality in the field of legal regulation of labor legal relations. However, the issue of political and legal aspects of gender has not received necessary attention in the research of scholars yet. The formation of gender policy by state institutions provides an impetus for the development and reform of legislation on gender issues in the labor sphere. Nevertheless, the formation of proper legal regulation of gender in the labor sphere is not possible without determining its political directions. The political and legal guide of gender in the labor sphere is revealed through the wellestablished interaction of state institutions regarding the formation of gender policy, reforming legislation in the labor sphere with the aim of bringing it closer to the equalization of the rights and interests of women and men while realizing their right to work, implementation of effective system of control over the prevention of discrimination in labor relations. It has been emphasized that the legislation in the labor sphere is female-oriented and in some cases does not provide guarantees for the realization of the right to work for men. The author believes that the gender policy and legislative regulation of labor relations needs to be reformed to equalize the subjective rights and legitimate interests of women and men. It has been concluded that the state plays a strategic role in the implementation of the gender principle in the labor sphere by establishing political and legal guidelines that correspond to the state’s public order. It has been emphasized that the current legislation of Ukraine enshrines the principle of gender equality regarding the realization of the right to work. However, the implementation of this principle is far from ideal. | uk_UA |
| dc.description.abstract | У статті розглянуто ґендер як політико-правовий орієнтир у сфері праці. Встановлено, шо політичний та правовий аспект дослідження ґендеру нерозривно пов’язані та взаємозалежні. Зауважено, що формування ґендерної політики державними інституціями дає поштовх для розвитку та реформування законодавства з ґендерних питань у сфері праці. Водночас формування належного правового регулювання ґендеру у сфері праці не можливо без визначення його політичних напрямів. Наголошено, що законодавство у сфері праці є жіночоорієнтованим і в окремих випадках не передбачає гарантій реалізації права на працю для чоловіків. Вбачається, що ґендерна політика та законодавче регулювання трудових відносин потребує реформування з метою урівняння суб’єктивних прав та законних інтересів жінок і чоловіків. | uk_UA |
