| Короткий огляд (реферат): | У статті на основі аналізу праць науковців визначено поняття етапів розслідування, їх значення у теорії криміналістики та практиці розслідування кримінальних правопорушень. Встановлено, що розслідування потрібно поділяти на два етапи: початковий і подальший. Визначено зміст кожного з етапів та розглянуто дискусійне в науці питання щодо їх розмежування. Обґрунтовано позицію автора щодо моменту закінчення початкового та початку подальшого етапу, яким є виявлення особи, підозрюваної у вчиненні кримінального правопорушення. |
| Опис: | The article based on the analysis of the opinions of scientists, deals with definition of the concept of stages of investigation, their significance in the theory of criminology and the practice of investigating criminal offenses. It has been established that the investigation should be divided into two stages: initial and subsequent. The main features of the initial stage are the search orientation, detection, fixation and removal of evidence that may serve as initial information for the identification and search of the offender, the place of his/her possible appearance. The actions of the investigator and employees of operational units are characterized by maximum speed, in most cases involving a large number of participants, the urgency of investigative actions. The next stage is characterized by resolving problematic situations regarding the main structural elements of the subject of evidence, the main of which are the event and method of committing a criminal offense, establishing the degree of guilt of the person, identifying all accomplices. The information available to the investigator at this stage differs in greater volume, logical order and specificity, a variety of procedural sources of evidence and a focus on evidence. The debatable question in science concerning delimitation of stages of investigation is considered. The author‟s position on the moment of the end of the initial and the beginning of the next stage, which is the identification of a person suspected of committing a criminal offense, has been substantiated. |
