| Короткий огляд (реферат): | У статті на основі аналізу чинного законодавства, наявних наукових, публіцистичних та методичних джерел, у тому числі зарубіжного досвіду, зʼясовано сутність та значення публічного контролю за додержанням законодавства у сфері забезпечення охорони вод та відтворення водних ресурсів та його роль у реалізації державної екологічної політики. Окреслено характерні риси публічного контролю в механізмі адміністративно-правового забезпечення охорони вод та відтворення водних ресурсів, який являє собою діяльність уповноважених органів державної влади, місцевого самоврядування та окремих інституцій громадянського суспільства з перевірки дотримання субʼєктами екологічних правовідносин норм, правил і стандартів водного законодавства. |
| Опис: | The article, based on the analysis of current legislation, available scientific, journalistic and methodological sources, including foreign experience, clarifies the essence and significance of public control over compliance with legislation in the field of water protection and reproduction of water resources and its role in state environmental policy. The characteristic features of public control in the mechanism of administrative and legal support of water protection and reproduction of water resources, which is the activity of authorized bodies of state power, local government and individual civil society institutions to verify compliance with environmental laws, rules and standards of water legislation. It has been found that the subject of public control over the use and protection of water and reproduction of water resources is the activities of controlled entities for the actual implementation of water legislation, regulations, instructions, rules, regulations and standards for water protection, as well as quantitative and qualitative results. activities, the expediency of choosing the means and methods of fulfilling their water protection responsibilities. The task of public control over the use and protection of water and reproduction of water resources, which is to ensure compliance by all legal entities and individuals with the requirements of water legislation, is compliance with legal regulations to ensure conservation, scientifically sound, rational use of water for the population and sectors of the economy, reproduction of water resources, protection of water from pollution, clogging and depletion, prevention of harmful effects of water and elimination of their consequences, improvement of water bodies, as well as protection of the rights of enterprises, institutions, organizations and citizens to water use. The destructive factors that hinder the effective implementation of public control over compliance with water legislation and rational use of water resources have been identified, and a set of measures has been proposed to improve it. |
