| Короткий огляд (реферат): | В статье исследуется уголовно-правовое обеспечение защиты прав и свобод человека в сфере семейно-бытовых отношений. Анализируется уголовное законодательство Украины и Республики Казахстан. Уголовные правонарушения в семейно-бытовой сфере посягают на честь и достоинство женщин, является прямым нарушением их прав и свобод. Гендерное насилие разрушает здоровье, оно рушит семьи, деформирует моральные, культурные, эстетические ценности общества, тормозит социальное развитие. Систему преступлений в семейно-бытовой сфере образуют такие преступления как: умышленное убийство, умышленные тяжкие телесные повреждения, умышленные средние телесные повреждения, умышленное легкое телесное повреждение, побои и истязания, изнасилование, уклонение от уплаты алиментов и другие. |
| Опис: | The article examines the criminal law support for the protection of human rights and freedoms in the field of family and household relations. The article analyzes the criminal legislation of Ukraine and the Republic of Kazakhstan. Criminal offenses in the family and everyday life encroach on the honor and dignity of women and constitute a direct violation of their rights and freedoms. Gender violence destroys health, it destroys families, deforms the moral, cultural, and aesthetic values of society, and inhibits social development. The system of crimes in the family and everyday life is formed by such crimes as: premeditated murder, premeditated grievous bodily harm, premeditated medium bodily injury, premeditated minor bodily injury, beatings and torture, rape, evasion of payment of alimony, and others. А crime in the sphere of family and domestic relations in the Republic of Kazakhstan is not criminalized. However the current criminal legislation of the Republic of Kazakhstan provides for 20 corpus delicti, according to which criminal acts in the family and household sphere can be qualified. Also, the administrative code contains norms according to which the perpetrators can be brought to administrative responsibility for violations in the field of family and domestic relations. Almost all norms are related, with the exception of two special administrative ones, one of them in the field of administrative prevention. Ukraine and the Republic of Kazakhstan today are in an active phase of transformation not only of public consciousness about the problem of violence in the family and household environment, but also of the formation of an effective regulatory framework that meets the requirements of international documents aimed at ensuring, protecting and realizing human rights from violence. |
