| Короткий огляд (реферат): | Стаття присвячена висвітленню загальної характеристики чинників, що впливають на процес організації й тактики проведення слідчих (розшукових) дій в умовах епідемії (пандемії). Підкреслюється, що формування нових умов діяльності державних інституцій взагалі та органів досудового розслідування зокрема, визначають необхідність їх адаптації у відповідності до потреб обставин. Аналізуються статистичні відомості Генеральної прокуратури України через призму сформованих пандемією COVID-19 умов розслідування. |
| Опис: | The article deals with the general characterization of factors influencing the organization and tactics of investigative (search) actions in the context of an epidemic (pandemic). It is emphasized that the emergence of new conditions for the work of State institutions and pre-trial investigation bodies, in particular, determine the need to adapt them to the needs of the situation. At the same time, without taking into account the factors that lead to the transformation of conditions, the activity of authorized persons in preparing and carrying out investigative (search) actions can be complicated (impossible). The article analyses the statistical data of the Office of the Procurator-General of Ukraine from the standpoint of the COVID-19 pandemic. It has been noted that determining the number of persons infected in the course of participating in an investigation can only be hypothetical. These judgements may be based on information on illnesses of medical and police staff who, by the nature of their work, are at high risk of infection in the performance of their duties. Consequently, both participants in criminal proceedings and outsiders may be at increased risk of contracting infectious diseases. Attention is drawn to the fact that the falsification of COVID certificates or PCR tests, which have become widespread, makes it difficult to assess the actual disease situation in the State and hence to determine the risk of infection of participants in investigative (search) tests It is submitted that the presence of COVID certificates or PCR tests does not guarantee a safe environment for participants in criminal proceedings and outsiders. However, the Committee notes with concern that the COVID certificates and PCR tests are not available to the public. Accordingly, the documents submitted by the participants, prior to the completion of investigative (search) actions, need to be checked for their authenticity, including using «Diya» in the annex. It has been emphasized that the list of factors considered in the article is primarily indicative of the importance of being independent of the will of the authorized persons and of the conditions which give rise to them, which, however, should be taken into account in the investigation in general and in the conduct of individual investigative (search) actions in particular. The conclusions point to the need for further substantive studies, taking into account the reasons given and other reasons for the processes under consideration. |
