Abstract: Здійснено комплексний аналіз адміністративного правопорушення у сфері безпеки дорожнього руху. Досліджено визначення поняття безпеки дорожнього руху; об’єктивні та суб’єктивні ознаки; підстави адміністративної відповідальності; адміністративні стягнення, що застосовуються у разі порушення правил дорожнього руху. Проаналізовано склад адміністративного правопорушення за порушення правил дорожнього руху. Виконано аналіз адміністративних стягнень за правопорушення у сфері безпеки дорожнього руху й визначено недоліки, які впливають на ефективність їх практичного застосування. Виділено основні матеріально-правові й процесуально-правові особливості адміністративної відповідальності суб’єктів дорожніх відносин.
Description: The article deals with analysis of administrative offenses in the field of road safety. The article considers: definition of road safety; objective and subjective features; grounds for administrative liability; administrative penalties applied in violation of traffic rules. The composition of an administrative offense for violation of traffic rules is analyzed. It is determined that the concept of "road safety" is not codified, but at the same time it is used in many regulations without explaining its content. A comprehensive analysis of administrative penalties for offenses in the field of road safety and identified shortcomings that affect the effectiveness of their practical application. The main substantive and procedural features of administrative liability of the subjects of road relations are highlighted. It was concluded that the legislator, based on international experience, aims to amend existing legislation that may have a positive impact on solving problems related to traffic. However, some legal norms do not meet international standards, which makes it impossible to use them in practice. Conflicting issues of national legislation in this area can be resolved through some changes. In particular, subject to the principles of legality, expediency, fairness and reasonableness, it is possible to apply administrative liability for offenses in the field of road safety, which are recorded automatically; it is necessary to edit the substantive and procedural rules on administrative penalties for violating traffic rules in accordance with the requirements of modern society, as most rules are outdated, which makes them ineffective, and in some cases - completely ineffective. It can be stated that in the administrative legislation in the field of road traffic, despite its dynamism and detailed elaboration, there are many gaps and contradictions, which, given the growing relevance, requires further research to make sound proposals to update existing legislation in this area.
