| Короткий огляд (реферат): | Розглянуто питання наукової розробленості проблем здійснення контрольованої поставки як форми контролю за вчиненням злочинів в Україні. Проаналізовано основні положення сучасних наукових розробок у галузях кримінального процесу, криміналістики, теорії оперативно-розшукової діяльності. Автори на підставі аналізу існуючих точок зору, результатів особистого дослідження виказують власне ставлення до означеного питання та пропонують якісно нові підходи до визначення перспективних напрямів подальших наукових розробок. |
| Опис: | The article is sanctified to the questions of scientific worked out of problems of realization of the controlled delivery as control forms after committing crime in Ukraine. In the article the substantive provisions of modern scientific developments are analyzed in industries of criminal process, criminalistics, theory of operational search activity. The historical aspects of the legislative fixing and use of the controlled delivery are analyzed in practice of activity of law enforcement authorities, and also international experience. Authors are given determination of the controlled delivery, distinguished its tactical tasks, as control forms after committing crime. The controlled delivery is examined as an operational search event, and also as a secret inquisitional (of criminal investigation) action. The authors have made comparative analysis of criminal judicial and operational search legislation. The norms of department normative acts of Ministry of internal affairs and National police are investigated on questions organization and tactics of realization of the controlled delivery as a control form after the commission of crime. Basic theoretical, normatively-legal and organizationally-tactical problems that reduce efficiency of the use of the controlled delivery are reflected, as control forms after committing crime in practice of law enforcement authorities of Ukraine. Among them: imperfection of the normatively-legal providing of the use of the controlled delivery, as control forms after committing crime, and also theoretical and scientifically-methodical under exploitation of questions of organization and tactics of realization of the controlled delivery, as control forms after committing crime. Authors, on the basis of analysis of existent points of view, results of the personal research express own attitude toward the marked questions and the new going offer qualitatively near determination of perspective directions of further scientific developments in relation to organization and tactics of realization of the controlled delivery. |
